In this Disclaimer, "we", "us", "our", and "the Service" have the same meaning as in the Terms of Service.

1. How this Disclaimer works

This Disclaimer forms part of, and is incorporated into, the Terms of Service for The DTC Playbook. It should be read together with the Terms and our Privacy Policy.

By using the Service, you acknowledge that you have read this Disclaimer and understand that the Service is general educational material only.

2. Educational content only

The DTC Playbook provides general educational information, frameworks, checklists, examples, and commentary based on experience and opinion. It is designed to help you think more clearly about direct-to-consumer businesses, not to give you personalised advice for your specific situation.

3. No professional advice or professional relationship

Nothing in the Service is legal advice, tax advice, accounting advice, financial advice, investment advice, due diligence advice, or any other regulated or professional advice.

Your use of the Service does not create a consultant-client, lawyer-client, accountant-client, financial adviser-client, fiduciary, partnership, joint venture, or other professional relationship between you and us.

4. No guarantee of results

We do not promise or guarantee that the Service will produce any particular business outcome, financial result, growth rate, valuation outcome, fundraise result, exit outcome, or operational improvement.

5. No reliance

You remain solely responsible for evaluating whether any strategy, benchmark, framework, case study, template, or recommendation is appropriate for your circumstances. You should independently verify information before acting on it.

6. Examples, benchmarks, calculators, and templates

Any examples, case studies, scenarios, calculators, spreadsheets, downloadable templates (including but not limited to the DTC P&L Template, DTC Economics Calculator, 13-Week Cash Flow Forecast, Customer Acquisition Planner, Customer Persona Builder, Brand Foundations & Positioning, Cat-Geo Planner, and Valuation Calculator), benchmarks, rules of thumb, or references to outcomes are provided for illustration and education only. They are not predictions, promises, warranties, or guarantees.

Pre-filled sample numbers in calculators and templates are illustrative defaults intended to show how the tool works. They are not recommendations for your business and should be replaced with your own figures before any decision is made.

The Service does not perform an audit, valuation, due diligence, financial model review, or regulatory check on any number you enter or any result the calculators produce.

7. Accuracy and currency

We aim to keep the Service useful and accurate, but the DTC landscape changes quickly. Tools, ad platforms, AI products, ecommerce systems, benchmarks, and channel economics may change without notice. We do not warrant that all content will always be complete, current, or error-free. As set out in the Terms of Service, the Service is provided on an "as is" and "as available" basis.

8. Third-party tools and brands

The Service may refer to third-party brands, platforms, software, and services. We are not responsible for their availability, pricing, policies, or performance. Any third-party trademarks remain the property of their respective owners.

9. Health Check, calculator, and template limitations

The DTC Health Check is a self-assessment tool. Its scores and outputs are based on the information you provide and are intended as indicative educational feedback only.

The downloadable calculators, spreadsheet templates, and exported files made available through the Service are educational frameworks. They use the figures you enter to produce illustrative outputs. They are not personalised modelling, not professional advice, and not a substitute for your own analysis or qualified advice.

Health Check results, calculator outputs, and template results are not an audit, valuation, due diligence report, legal review, financial model, investment recommendation, or guarantee of performance. They should not be used as your only basis for decision-making.

Your Health Check submissions may contribute to aggregated, anonymised benchmarks and industry insights as described in our Terms of Service and Privacy Policy. These insights do not identify you or your business personally.

10. Investor and financial disclaimer

Nothing in the Service constitutes financial product advice, investment advice, or a recommendation to acquire, dispose of, fund, or value any business, asset, or security.

11. Australian Consumer Law

Nothing in this Disclaimer excludes, restricts, or modifies any consumer rights or remedies that cannot be excluded under applicable law, including the Australian Consumer Law.

12. Liability

To the maximum extent permitted by law, and subject to any non-excludable rights, we are not liable for indirect, consequential, incidental, special, exemplary, or punitive loss arising from your use of the Service or reliance on its content, including loss of profit, revenue, goodwill, opportunity, savings, data, or business interruption.

The limitation of liability framework for the Service, including the aggregate liability cap, is set out in the Terms of Service. If there is any inconsistency between this Disclaimer and the Terms of Service, the Terms of Service govern to the extent permitted by law.
